Service of Legal Documents
It is the right of each litigant to receive copy of all the documents pertaining to a matter in which they are a party. The matter could be a civil matter, commercial matter or criminal matter. The party upon whom the documents need to be served could be an individual or a business enterprise. The service of documents in the same country is not a big deal but the process becomes a bit complicated when it comes to international process service. The multi-lateral treaty generally known as the Hague Convention sets out rules for service abroad of judicial and extra-judicial documents in Civil and Commercial matters. The service of documents between the signatory countries should be done in accordance with the provisions of the convention. However, the personal process service of documents is also useful in some circumstances as it saves a lot of time and efforts.
Service of Divorce Papers
We understand that divorce is generally the result of lack of understanding or compatibility between the spouses. The possibility that your spouse and his/her family will resist the acceptance of papers is high and thus we depute the process server according to the circumstances. We make all efforts to hand over the documents to the respondent and also to take written acknowledgement, wherever possible. Our process servers are well-trained to deal with situations that may arise during the service of documents.
Service of Child Custody Papers
The matters related to child custody are also sensitive and it is not uncommon that the respondent or her family members become aggressive or violent. Accordingly, we deal with utmost care and caution. We use experienced process servers who are capable of taking care of the situation and serve the papers successfully. We need to take care that the actions of our process server do not violate the local laws and that the service is done in accordance with the prescribed procedure.
Service of Summons, Subpoena etc.
Our process server will visit the residence of the respondent at a time when he is likely to be present there. We might have to visit there in the morning or evening, if he/she is working. The documents can also be served at the work place of the respondent if desired.
In case the documents need to be served upon a business enterprise, our operator will visit its registered address and serve the documents to a person who is duly authorized to accept documents on behalf of the enterprise. The name, designation and contact number of the person to whom the documents are delivered are mentioned in the Affidavit of Service.
